  1. Cost variation : All work is carried out in accordance with the prices indicated on the Company's prevailing price schedule. Any quotations given are normally based on this price schedule, but quotations may be offered for non-standard work. In such cases quotations are based on the current costs of production and are subject to amendment by the company on or at any time after acceptance to meet any rise or fall in such costs.
  2. Preliminary work : Work carried out, whether experimentally or otherwise, at the customer's request, will be charged.
  3. Proofs : Proofs are not normally submitted, but where specifically requested a charge may be made. No responsibility will be accepted, and the Company shall not be liable, for any errors in proofs approved by the customer.
  4. Collection and payments :
    1. Goods shall be accepted and payment shall become due immediately upon notification that goods are ready for collection. Payment terms are strictly cash on collection unless otherwise arranged.
    2. Should work be suspended at the request of or delayed through any default of the customer for a period of 30 days, the Company shall then be entitled to payment for work already carried out and materials specially ordered.
  5. The person, firm or company from whom the Company receives instructions ("the client") shall be liable to the Company as a principal for all costs, charges and expenses that shall be due to the Company in respect of work carried out or goods supplied by the Company subject to these conditions whether or not such client purports to act as an agent. A client may not assign the benefit or burden of any contract with the Company.
  6. Delivery : the Company does not undertake to carry out deliveries but where special arrangements have been made a charge may be made at the Company's discretion.
  7. Variations in quantity : Every endeavour will be made to deliver the correct quantity ordered, but prices and quotations are conditional upon a margin of five per cent being allowed for surplus or shortage, the same to be charged or deducted.
  8. Claims : Claims arising from damage, delay or partial loss of goods in transit must be made to the Company and the carrier so as to reach them within three days of delivery, and claims for non-delivery within twenty-eight days of despatch of goods. All other claims must be made to the Company within ten days of delivery or collection.
  9. Standing matter : Customer's original material and artwork may be returned or retained or destroyed at the Company's discretion after the order has been executed unless specific arrangements are made in writing.
  10. Customer's property and property supplied :
    1. Customer's property and all property supplied to the Company by or on behalf of the customer will be held at the customer's risk.
    2. Every care will be taken to secure the best results where materials or equipment are supplied by the customer, but responsibility will not be accepted for imperfect work caused by defects in or unsuitability of such materials or equipment.
    3. Where the customer supplies materials, adequate quantities shall be supplied to cover normal spoilage.
  11. General lien : The Company shall in respect of all unpaid debts due from the customer have a general lien on all goods and property in its possession and shall be entitled on the expiration of fourteen days' notice to the customer to dispose of such goods and property as it thinks fit and to apply any proceeds towards such debts.
  12. Liability :
    1. The Company shall not be liable in any way for any loss of whatsoever nature sustained by the customer or by any other person arising out of any errors in work produced or out of delay in completion or from any other cause whatsoever.
    2. Where instructions or advice are received or given orally by the Company, the Company shall have no liability to the client for any misunderstanding or misinterpretation which may arise in relation thereto whether on the part of the Company or the client.
  13. Unlawful or tortious material : The Company shall not be required to print any matter which in its opinion is or may be of an unlawful, criminal, tortious or libellous nature.
  14. Indemnity : The customer shall indemnify and keep indemnified the Company against all claims, costs, demands and expenses against the Company or any of its employees, howsoever incurred, arising out of the printing or distribution by the Company of any matter that is or may be unlawful, criminal, tortious or libellous, or that infringes or may infringe any copyright, patent or design.
  15. Force Majeure : Every effort will be made to carry out the contract, but its due performance is subject to cancellation by the Company or to such variation as it may find necessary as a result of inability to secure labour, materials or supplies, or as a result of any Act of God, war, strike, lockout or other labour dispute, fire, flood, drought, legislation or any other cause (whether of the foregoing class or not) beyond the Company's control.
